Agreement to Terms
Welcome to Lens. These Terms of Service ("Terms") govern your access to and use of the Lens WordPress plugin, website (lensforwp.com), and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
Please read these Terms carefully before using Lens. If you do not agree to these Terms, you may not use our Services. These Terms constitute a legally binding agreement between you (either as an individual or on behalf of an entity) and Lens.
Important: By purchasing Lens Pro, installing the Lens plugin, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Definitions
For the purposes of these Terms:
- "Lens," "we," "us," or "our" refers to the Lens WordPress plugin and its operators.
- "You" or "your" refers to the individual, company, or legal entity using the Services.
- "Plugin" refers to the Lens WordPress media library folder management plugin, including both free and Pro versions.
- "Services" refers to the Plugin, website, customer dashboard, support services, and any related services we provide.
- "License" refers to the right granted to you to use Lens Pro under these Terms.
- "Site" or "WordPress Site" refers to your WordPress installation where the Plugin is installed.
- "Content" refers to text, images, data, and other materials accessed through or created using the Services.
License Grant and Restrictions
Lens Free Version
The Lens free version is licensed under the GNU General Public License v2.0 or later (GPL-2.0+), consistent with WordPress licensing requirements. You may use, modify, and distribute the free version in accordance with the GPL license terms.
Lens Pro License
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use Lens Pro on the number of WordPress sites permitted by your purchased license tier
- Access premium features and functionality included with Lens Pro
- Receive software updates and support during your active subscription period
License Restrictions
You may NOT:
- Use Lens Pro on more sites than permitted by your license tier
- Redistribute, sell, lease, rent, or sublicense Lens Pro to third parties
- Remove or modify any proprietary notices, labels, or marks on the Software
- Reverse engineer, decompile, or disassemble Lens Pro (except to the extent permitted by applicable law)
- Use the Software for any illegal purpose or in violation of any laws
- Share your license key with unauthorized parties
- Use the Software to create a competing product or service
- Attempt to circumvent any license validation or activation mechanisms
License Tiers
Lens Pro is available in multiple license tiers based on the number of sites:
- Essential (1 Site): Use on one (1) WordPress site - includes all core features
- Advanced Solo (1 Site): Use on one (1) WordPress site - includes all features plus collaboration and sharing
- Advanced (3 Sites): Use on up to three (3) WordPress sites - includes all features
- Expert (25 or 1000 Sites): Use on up to twenty-five (25) or one thousand (1,000) WordPress sites depending on your selected tier - includes all features
A "site" is defined as a single WordPress installation with a unique domain or subdomain. Multisite installations count as one site if all subsites share the same parent domain.
Account Registration and Security
Account Creation
To purchase and use Lens Pro, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your login credentials
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities under your account
Account Eligibility
You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account and use our Services. By creating an account, you represent that you meet these eligibility requirements.
Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You provide false or misleading information
- Your payment method fails or is disputed
- We suspect fraudulent, abusive, or illegal activity
- Required by law or legal authority
Payment Terms and Billing
Pricing and Fees
Lens Pro is available as an annual subscription. Current pricing tiers are:
- Essential: $60/year ($4.99/month equivalent) for 1 site
- Advanced Solo: $84/year ($6.99/month equivalent) for 1 site with collaboration features
- Advanced: $99/year ($8.25/month equivalent) for up to 3 sites
- Expert: Starting at $204/year ($16.99/month equivalent) for up to 25 sites, with higher tiers available for up to 1000 sites
We reserve the right to modify pricing with 30 days' notice to existing customers.
- All prices are in USD unless otherwise stated
- Prices do not include applicable taxes, which will be added at checkout
- Payment is due immediately upon purchase
- All fees are non-refundable except as required by law or stated in our refund policy
Subscription Renewals
Lens Pro subscriptions automatically renew annually unless you cancel before the renewal date. You will be charged the then-current renewal rate. We will send you a reminder email before each renewal.
- Renewal notices are sent 14 days before the renewal date
- You can cancel renewal anytime from your account dashboard
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial subscription periods after cancellation
Payment Methods
All payments for Lens Pro are processed through Freemius, our trusted payment and licensing platform. Freemius handles all payment processing, license management, and customer account management on our behalf.
Through Freemius, we accept payment via credit card, debit card, and PayPal. Freemius uses Stripe and PayPal as payment processors. We do not directly store or have access to your complete payment information.
By purchasing Lens Pro, you agree to Freemius's Terms of Service and Privacy Policy in addition to these Terms.
Failed Payments
If a renewal payment fails:
- We will attempt to process payment up to 3 times over 14 days
- You will receive email notifications of failed payment attempts
- Your license will be suspended if payment is not received within 14 days
- Access to Pro features will be disabled until payment is resolved
Refund Policy
We offer a 14-day money-back guarantee for new Lens Pro purchases. If you're not satisfied with Lens Pro, you may request a full refund within 14 days of purchase by contacting support@lensforwp.com or through your Freemius account dashboard.
Refund conditions:
- Refunds are only available for initial purchases, not renewals
- Request must be made within 14 days of original purchase date
- Refunds are processed by Freemius to the original payment method within 5-10 business days
- License will be deactivated upon refund approval
- We reserve the right to deny refunds for suspected abuse or fraud
Note: All refunds are processed through Freemius and are subject to Freemius's refund processing policies.
Taxes
You are responsible for all applicable taxes, including sales tax, VAT, GST, or similar taxes. Tax amounts will be calculated and added to your invoice at checkout based on your billing address. For EU customers, VAT is charged according to your country's rate unless you provide a valid VAT ID.
Software Updates and Support
Software Updates
During your active subscription period, you will receive:
- All software updates, including bug fixes and security patches
- New features and functionality as they become available
- Compatibility updates for new WordPress versions
Updates are delivered through the WordPress plugin update system. We recommend enabling automatic updates for security patches. After your subscription expires, you may continue using the version you have installed, but will not receive new updates.
Customer Support
Support is provided as follows:
- Lens Free: Community support via WordPress.org forums
- Lens Pro: Priority email support during active subscription period
Support is provided in English and covers:
- Plugin installation and configuration assistance
- Bug reports and troubleshooting
- Feature usage guidance
- Compatibility issues with WordPress core and popular plugins
Support does NOT include:
- Custom development or modifications
- Server configuration or hosting support
- Third-party plugin or theme conflicts (unless caused by Lens)
- Training or consulting services
We aim to respond to support requests within 24-48 hours during business days (Monday-Friday). Response times may be longer during weekends, holidays, or periods of high volume.
Your Responsibilities
Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Services in any way that violates applicable laws or regulations
- Use the Services to transmit or store illegal, harmful, or offensive content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Services or servers
- Use automated systems (bots, scrapers) to access the Services without permission
- Attempt to circumvent security or authentication measures
- Engage in any activity that could damage our reputation or business
System Requirements
You are responsible for ensuring your WordPress installation meets the minimum system requirements:
- WordPress 5.8 or higher
- PHP 7.4 or higher (8.0+ recommended)
- MySQL 5.6 or higher, or MariaDB 10.0 or higher
- Sufficient server resources for your media library size
Backups
You are solely responsible for maintaining backups of your WordPress site, database, and content. While Lens is designed to preserve your media organization data, we strongly recommend:
- Creating a complete site backup before installing or updating Lens
- Implementing a regular automated backup solution
- Testing your backups periodically to ensure they can be restored
We are not responsible for any data loss, regardless of cause.
Content Ownership
You retain all ownership rights to your content, media files, and data. Lens does not claim any ownership over your content. You are responsible for ensuring you have the necessary rights and permissions for all content you upload or manage using Lens.
Intellectual Property Rights
Our Property
The Services, including the Plugin software, website design, documentation, logos, trademarks, and all related intellectual property, are owned by Lens and protected by copyright, trademark, and other intellectual property laws.
Subject to your license rights under these Terms, all rights, title, and interest in the Services remain with Lens. These Terms do not grant you any intellectual property rights except as explicitly stated.
Trademarks
"Lens" and our logo are trademarks of Lens. You may not use our trademarks without our prior written permission, except as necessary to accurately describe your use of our Services (e.g., "Powered by Lens" or "Using Lens for WordPress media management").
Feedback and Suggestions
If you provide feedback, suggestions, or ideas about the Services, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback into our Services without compensation or attribution to you.
DMCA and Copyright Infringement
We respect intellectual property rights. If you believe content accessible through our Services infringes your copyright, please contact us at support@lensforwp.com with:
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location
- Your contact information
- A statement of good faith belief that the use is not authorized
- A statement that the information is accurate and you are authorized to act
- Your physical or electronic signature
Disclaimers and Limitations of Liability
Service "As Is"
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will be uninterrupted, error-free, or completely secure
- The Services will meet your specific requirements
- Any errors or defects will be corrected
- The Services will be compatible with all WordPress configurations, themes, or plugins
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENS AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
- COST OF SUBSTITUTE GOODS OR SERVICES
- BUSINESS INTERRUPTION OR DOWNTIME
- DATA LOSS OR CORRUPTION
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of implied warranties or liability for incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you.
Freemius Payment and Licensing Platform
Critical Notice: Lens Pro uses Freemius (freemius.com) as our payment processing, licensing, and customer management platform. When you purchase Lens Pro:
- Freemius processes and stores your payment information
- Freemius manages your license keys and activations
- Freemius handles your account, subscriptions, and billing
- Freemius manages refund requests and customer data
- Your data is subject to Freemius's Privacy Policy and Terms of Service
You must review and agree to Freemius's policies available at freemius.com/terms and freemius.com/privacy.
Other Third-Party Services
The Services may integrate with or link to other third-party websites, plugins, or services. We are not responsible for:
- The availability, accuracy, or content of third-party services
- Third-party privacy practices or terms of service
- Any damages or losses caused by third-party services
Your use of third-party services is at your own risk and subject to their terms and conditions.
Indemnification
You agree to indemnify, defend, and hold harmless Lens and its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from or related to:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any rights of third parties
- Your content or data stored using the Services
- Any negligent or wrongful conduct on your part
We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.
Term and Termination
Term
These Terms begin when you first access or use the Services and continue until terminated by either party.
Termination by You
You may terminate these Terms at any time by:
- Canceling your Lens Pro subscription from your account dashboard
- Uninstalling the Plugin from your WordPress site(s)
- Closing your account by contacting support
Termination does not entitle you to a refund except as provided in our refund policy.
Termination by Us
We may suspend or terminate your access to the Services immediately, without notice or liability, if:
- You violate these Terms
- Your payment fails or account is past due
- We suspect fraudulent, abusive, or illegal activity
- We discontinue the Services (with reasonable notice)
- Required by law or legal authority
Effect of Termination
Upon termination:
- Your license to use Lens Pro immediately terminates
- You will lose access to premium features and support
- You may continue using the version installed, but will not receive updates
- Your folder organization data remains in your WordPress database
- We may delete your account information after a reasonable period
Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions.
Dispute Resolution and Governing Law
Informal Resolution
Before filing a formal claim, you agree to contact us at support@lensforwp.com to attempt to resolve any dispute informally. We will work with you in good faith to reach a mutually acceptable resolution.
Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction where Lens is registered, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of that jurisdiction.
Arbitration Agreement
You and Lens agree that any dispute arising from these Terms or the Services will be resolved through binding arbitration, rather than in court, except that either party may bring a claim in small claims court if it qualifies.
The arbitration will be conducted by a neutral arbitrator in accordance with the applicable arbitration rules. The arbitrator's decision will be final and binding. Each party will bear its own costs and attorneys' fees, unless the arbitrator determines otherwise.
Class Action Waiver
You agree that any arbitration or legal proceeding will be conducted on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding.
EU and UK Consumers
If you are a consumer located in the European Union or United Kingdom, nothing in these Terms affects your statutory rights under applicable consumer protection laws. You may bring legal proceedings in the courts of the country where you reside.
General Provisions
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of these Terms
- Notify you via email if you have an active Pro subscription
- Display a prominent notice on our website
Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services and cancel your subscription.
Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Lens regarding the Services and supersede all prior agreements, representations, and understandings.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. A waiver of any breach does not waive any subsequent breach.
Assignment
You may not assign or transfer these Terms or your rights and obligations without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
Force Majeure
We will not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
Export Compliance
The Services may be subject to export control laws. You agree to comply with all applicable export and import laws and regulations in your use of the Services. You represent that you are not located in a country subject to embargo or on any government restricted party list.
Relationship
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Lens. Neither party has authority to bind the other or incur obligations on the other's behalf.
Language
These Terms are written in English. Any translations are provided for convenience only. In the event of conflict between the English version and any translation, the English version shall prevail.
